1. Introduction and Acceptance By accessing or using Probull.AI's artificial intelligence services, platform, website, or applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Probull.AI Inc. ("Probull.AI," "we," "us," or "our"). If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms. 2. Definitions "AI Creations" means any output, content, or material generated, produced, or created by our AI systems based on User inputs. "AI Services" means our artificial intelligence and machine learning systems, algorithms, models, and related technologies that generate outputs based on User inputs. "Content" means any data, information, text, images, prompts, or other materials uploaded, inputted, or provided to our Services. "User Data" means any data or information that you provide to us or our Services, including but not limited to inputs, prompts, and account information. "Financial Data" means any market data, stock prices, trading signals, investment recommendations, or other financial information provided through our Services. "Trading Decisions" means any decisions to buy, sell, or hold financial instruments based on information provided by our Services. 3. Services Description 3.1 AI Services Probull.AI provides artificial intelligence services that generate outputs based on User inputs. Our Services may include, but are not limited to, text generation, image creation, data analysis, and other AI-powered functionalities. 3.2 Service Modifications We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice, for any reason whatsoever, at our sole discretion. We may also impose limits on certain features or restrict access to parts or all of the Services without liability or obligation to you. 4. Account Registration and Security 4.1 Account Creation To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. 4.2 Account Security You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. 4.3 Account Termination We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason whatsoever without any liability to you. 5. Licensing and Intellectual Property 5.1 License to Use Services Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our Services for your internal business or personal purposes. 5.2 Restrictions on Use You shall not: Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of our Services Modify, adapt, or create derivative works based on our Services Sell, resell, license, sublicense, distribute, rent, or lease our Services Use our Services to develop competing products or services Remove, alter, or obscure any proprietary notices on our Services Use our Services in any manner that violates applicable laws or regulations Conduct penetration testing, load testing, or security scanning without our prior written consent Exceed usage limitations or quotas specified in your subscription plan Use the Services in any way that could damage, disable, overburden, or impair our servers or networks Attempt to gain unauthorized access to any part of the Services Use the Services to transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature 5.3 Intellectual Property Rights in AI Services All rights, title, and interest in and to our Services, including all intellectual property rights, are and will remain the exclusive property of Probull.AI and its licensors. Nothing in these Terms shall be construed as transferring any aspects of such rights to you or any third party. 5.4 Rights in AI Creations Any intellectual property rights in AI Creations, excluding User Data incorporated therein, shall belong to Probull.AI. We grant you a non-exclusive, worldwide license to use, reproduce, modify, and display the AI Creations for your business purposes, subject to your compliance with these Terms and all applicable laws. 5.5 User Data License You retain all rights to your User Data. You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Data for the purposes of: Providing and maintaining our Services Improving and training our AI models and algorithms Complying with applicable laws and regulations Enforcing our rights under these Terms Protecting the rights, property, or safety of Probull.AI, our users, or others 6. AI-Specific Provisions 6.1 AI Disclaimer THE AI SERVICES PROVIDED BY PROBULL.AI ARE EXPERIMENTAL TECHNOLOGIES THAT MAY PRODUCE UNPREDICTABLE, INACCURATE, OFFENSIVE, OR OTHERWISE UNDESIRABLE OUTPUTS DESPITE OUR SAFEGUARDS. THE CONTENT GENERATED BY OUR AI SERVICES MAY BE FACTUALLY INCORRECT, FALSE, MISLEADING, ILLEGAL, UNETHICAL, OR OTHERWISE INAPPROPRIATE. PROBULL.AI MAKES ABSOLUTELY NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, QUALITY, SUITABILITY, OR APPROPRIATENESS OF ANY AI OUTPUTS. Our AI systems generate content based on patterns learned from training data and may produce outputs that: Contain significant errors, inaccuracies, or inappropriate content Violate intellectual property rights, privacy rights, or other rights Contain outdated, biased, distorted, or misleading information Are socially biased, offensive, or otherwise inappropriate Appear authoritative but are factually wrong ("hallucinations") YOU ACKNOWLEDGE AND AGREE THAT ANY RELIANCE ON OR USE OF ANY AI CREATIONS IS AT YOUR SOLE RISK. YOU ASSUME COMPLETE RESPONSIBILITY FOR EVALUATING, VERIFYING, EDITING, AND DETERMINING THE APPROPRIATENESS OF ANY AI CREATIONS BEFORE USING THEM FOR ANY PURPOSE. 6.2 Acceptable Use Policy You agree not to use our Services to: Generate, upload, or distribute content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity Generate content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware Interfere with or disrupt our Services or servers or networks connected to our Services Violate any applicable local, state, national, or international law or regulation Create outputs that may be used for illegal purposes or activities that may harm others Attempt to manipulate financial markets or engage in securities fraud Generate content that promotes illegal activities, violence, self-harm, or terrorism Develop harmful or malicious software or code 6.3 Human Review Requirement You agree to independently review and verify all AI outputs before using them for any commercial, legal, financial, medical, or other significant purpose. This includes: Conducting factual verification of any claims or statements Ensuring compliance with applicable laws and regulations Validating any calculations, formulas, or numerical outputs Reviewing content for potential biases, inaccuracies, or inappropriate material Obtaining appropriate professional advice before acting on any AI-generated recommendations 7. Payment Terms 7.1 Fees and Billing If you subscribe to a paid plan, you agree to pay all fees associated with your selected subscription plan. All fees are exclusive of taxes unless stated otherwise. 7.2 Billing Cycle We will bill you on a recurring basis (monthly, annually, or as otherwise specified in your subscription plan). Billing cycles are based on the calendar month or year. 7.3 Automatic Renewal Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. 8. No Refund Policy 8.1 Absolute No-Refund Policy ALL SALES ARE FINAL. PROBULL.AI DOES NOT PROVIDE REFUNDS FOR ANY PAYMENTS MADE, REGARDLESS OF THE CIRCUMSTANCES. By subscribing to our Services, you acknowledge and agree that: All subscription fees and other charges are non-refundable under any circumstances whatsoever, including but not limited to: Dissatisfaction with the Services for any reason Technical issues, bugs, errors, or service interruptions of any kind or duration Accidental purchases or unintentional renewals Changes in your financial circumstances or business needs Failure to use the Services during the subscription period Early cancellation of a subscription plan Claims that the Service did not meet your expectations Changes in our Services, features, or functionality Your misunderstanding of any aspect of our Services Any claims of lost profits, trading losses, or financial damages 8.2 Subscription Cancellation You may cancel your subscription at any time by following the cancellation process in your account settings or by contacting support@probull.ai. Cancellation will take effect at the end of your current billing cycle, and you will continue to have access to the Services until that time. Cancellation does not entitle you to any refund or partial refund of fees already paid. Your obligation to pay all outstanding fees continues regardless of cancellation. 8.3 Billing Disputes If you believe you have been billed in error, you must contact us at billing@probull.ai within 7 days of the billing date. We will review your claim and, at our sole discretion, determine whether an adjustment is warranted. Any such adjustments will not include refunds for past charges but may include credits toward future services, which may be revoked at any time if your account is terminated for any reason. 9. No Free Trial 9.1 Absence of Trial Period PROBULL.AI DOES NOT OFFER FREE TRIALS OR TRIAL PERIODS FOR ANY OF ITS SERVICES UNDER ANY CIRCUMSTANCES. All subscriptions require immediate payment and are subject to our No Refund Policy as outlined in Section 8. 9.2 Demonstration Content Any demonstration content, sample outputs, or preview materials available on our website or marketing materials are provided solely for informational purposes and do not constitute a guarantee, warranty, or representation regarding the actual performance, accuracy, or capabilities of our Services. Such demonstrations may represent idealized usage scenarios and may not reflect the actual outputs you will receive. 9.3 Account Creation Creating an account with Probull.AI does not entitle you to any free access to our premium features or Services. All features require an active paid subscription unless explicitly marked as free. Any free features may be modified, limited, or removed at any time without notice. 10. Trading Disclaimer and Limitation of Liability 10.1 No Trading Advice PROBULL.AI DOES NOT PROVIDE INVESTMENT ADVICE, FINANCIAL ADVICE, OR TRADING RECOMMENDATIONS. OUR SERVICES DO NOT CONSTITUTE FINANCIAL, INVESTMENT, LEGAL, OR TAX ADVICE. Our Services provide tools, data analysis, and AI-generated insights that you may use as one of many inputs in your decision-making process. We do not recommend specific securities, trading strategies, or investment approaches. Nothing contained in our Services should be construed as a recommendation to buy, sell, or hold any investment or security, or to engage in any investment strategy or transaction. 10.2 Trading Risks TRADING AND INVESTING IN FINANCIAL MARKETS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INDIVIDUALS. YOU MAY LOSE ALL OR SUBSTANTIALLY ALL OF YOUR INVESTED CAPITAL. Past performance is not indicative of future results. The value of investments may fluctuate and can go down as well as up. Hypothetical or simulated performance results have inherent limitations and do not represent actual trading. 10.3 Zero Liability for Trading Losses PROBULL.AI BEARS ABSOLUTELY NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY TRADING OR INVESTMENT DECISIONS YOU MAKE BASED ON OUR SERVICES OR THE INFORMATION PROVIDED THROUGH OUR PLATFORM. PROBULL.AI SHALL NOT BE LIABLE FOR ANY LOSSES, DAMAGES, COSTS, OR EXPENSES INCURRED BY YOU OR ANY THIRD PARTY ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES FOR TRADING OR INVESTMENT PURPOSES. By using our Services, you acknowledge and agree that: You are solely responsible for all trading and investment decisions You accept full responsibility for any and all market losses You will not hold Probull.AI liable for any financial losses incurred while using our Services, regardless of the cause No communication from Probull.AI or through our Services should be considered as a guarantee of profit or protection from loss You will conduct your own research and due diligence before making any investment decisions You understand that automated trading based solely on our AI outputs carries significant risks You are not relying on Probull.AI to comply with your individual investment needs or objectives You waive any claim for damages of any kind against Probull.AI related to your trading activities 10.4 Indemnification for Trading Activities You agree to indemnify, defend, and hold harmless Probull.AI, its affiliates, officers, directors, employees, partners, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to your trading activities or investment decisions made in connection with our Services, including any claims made by third parties. 11. AI Limitations and Absolute User Responsibility 11.1 Inherent AI Limitations AI SYSTEMS, INCLUDING THOSE PROVIDED BY PROBULL.AI, HAVE INHERENT, UNAVOIDABLE, AND SIGNIFICANT LIMITATIONS AND WILL MAKE MISTAKES. These limitations include but are not limited to: Generating incorrect, incomplete, misleading, or fabricated information Producing outputs based on outdated, biased, or inaccurate training data Exhibiting systemic biases present in training data Failing to understand context, nuance, or intent in certain situations Generating plausible-sounding but factually incorrect content (hallucinations) Misinterpreting user inputs or queries Providing inconsistent responses to similar queries Producing outputs that may violate third-party intellectual property rights Creating content that may be offensive, inappropriate, or harmful Generating outputs that may be illegal or unethical in certain jurisdictions Failing to properly analyze complex market conditions or financial scenarios 11.2 Absolute and Unconditional User Responsibility YOU, AS A HUMAN USER, BEAR COMPLETE, ABSOLUTE, AND UNCONDITIONAL RESPONSIBILITY FOR ALL ACTIONS TAKEN BASED ON INFORMATION PROVIDED BY OUR AI SERVICES. PROBULL.AI ACCEPTS ZERO RESPONSIBILITY FOR ANY CONSEQUENCES RESULTING FROM YOUR USE OF OUR SERVICES, REGARDLESS OF THE CIRCUMSTANCES. By using our Services, you acknowledge and agree that: You will critically evaluate all AI outputs before acting upon them You will not blindly trust or implement AI suggestions without independent verification You are solely responsible for all consequences resulting from your use of our Services You will exercise independent judgment when using our Services You will comply with all applicable laws and regulations regardless of AI outputs You understand that AI outputs should be treated as suggestions rather than definitive answers You will not delegate your ethical, legal, or financial responsibilities to our AI systems You accept that AI outputs represent statistical probabilities, not factual certainties You understand that Probull.AI cannot predict or control all possible outputs You will use appropriate safeguards when implementing AI recommendations in critical contexts You waive any right to claim that you relied on our AI outputs in good faith 11.3 Professional Judgment Requirement Our Services are not a substitute for professional judgment, advice, or expertise. In regulated fields such as law, medicine, finance, engineering, or any other professional field, you must consult qualified professionals before making decisions based on our AI outputs. Probull.AI expressly disclaims any responsibility for decisions made in professional contexts based on our Services. 11.4 Prohibited Use Cases You shall not use our AI Services for: Critical safety applications where errors could lead to harm, injury, or death Fully automated decision-making affecting legal rights or similarly significant effects on individuals Applications where AI errors could lead to significant financial, physical, or psychological harm Critical infrastructure, emergency response, or public safety applications Medical diagnosis, treatment recommendations, or healthcare decisions Legal advice, court filings, or legal document preparation without attorney review Any purpose that violates applicable laws or regulations Any activity where accuracy, reliability, or correctness is essential 12. Financial Data Disclaimer 12.1 Data Sources and Limitations FINANCIAL DATA PROVIDED THROUGH PROBULL.AI IS COLLECTED FROM VARIOUS THIRD-PARTY SOURCES, INCLUDING PUBLIC APIS, INTERNET SEARCHES, AND DATA PROVIDERS, AND MAY NOT BE ACCURATE, COMPLETE, OR RELIABLE. PROBULL.AI MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY FINANCIAL DATA PROVIDED THROUGH OUR SERVICES. By using our Services, you acknowledge and agree that: Financial data may be delayed, inaccurate, incomplete, or contain errors Data may come from sources whose reliability cannot be guaranteed or verified Market conditions may change rapidly, making data outdated shortly after presentation Technical issues may affect data collection, processing, or display Data may be incomplete or missing for certain securities, time periods, or markets Calculations, projections, or analyses based on this data inherit all underlying data limitations Different data sources may provide conflicting information Historical data may not accurately reflect current market conditions Data may be subject to revision, correction, or adjustment without notice Probull.AI does not verify the accuracy of data from third-party sources 12.2 No Reliance on Charts and Data Visualizations YOU SHOULD NOT RELY EXCLUSIVELY ON CHARTS, GRAPHS, OR DATA VISUALIZATIONS GENERATED OR DISPLAYED BY PROBULL.AI. PROBULL.AI EXPRESSLY DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CHARTS OR VISUALIZATIONS. Such visualizations: May contain errors, omissions, or misleading representations May emphasize certain data points while obscuring others May use scales, timeframes, or visualization methods that affect interpretation Should be verified against other independent sources before making investment decisions May not account for corporate actions, splits, dividends, or other events May be generated using incomplete datasets May not accurately reflect market conditions, trends, or patterns May be misinterpreted depending on timeframe, scale, or context May create visual patterns that suggest trends where none exist May fail to include important contextual information 12.3 Independent Verification Requirement You agree to independently verify all financial data, charts, and information provided through our Services before making any investment or trading decisions. All financial data is provided "as is" and "as available" without any guarantees whatsoever. Data Privacy and Security 13.1 Privacy Policy Our collection and use of personal information in connection with your access to and use of the Services is described in our Privacy Policy, which is incorporated by reference into these Terms. 13.2 Data Security We implement reasonable administrative, technical, and physical safeguards designed to protect your User Data. However, no security system is impenetrable, and we cannot guarantee the security of our systems or your User Data. You acknowledge that you provide your User Data at your own risk. 14. Limitation of Liability 14.1 Disclaimer of Warranties THE SERVICES AND AI CREATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR QUALITY. PROBULL.AI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS. PROBULL.AI DOES NOT WARRANT THAT ANY INFORMATION PROVIDED THROUGH THE SERVICES IS ACCURATE, COMPLETE, OR USEFUL, OR THAT ANY AI CREATIONS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. 14.2 Comprehensive Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROBULL.AI, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES OR AI CREATIONS. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF PROBULL.AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL PROBULL.AI'S AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO OR ARISING OUT OF YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO PROBULL.AI DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY, OR $100 USD, WHICHEVER IS LESS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH CASES, PROBULL.AI'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. 14.3 Essential Purpose You acknowledge and agree that the limitations of liability set forth in this section are fundamental elements of the basis of the bargain between Probull.AI and you, and the Services would not be provided without such limitations. 14.4 Time Limitation on Claims You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. 15. Comprehensive Indemnification You agree to defend, indemnify, and hold harmless Probull.AI, its affiliates, licensors, service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: Your violation of these Terms Your use of the Services Any User Data uploaded or provided by you Your violation of applicable laws or regulations Your violation of any third-party rights, including intellectual property rights Any trading or investment decisions made based on our Services Any outputs generated by our AI systems in response to your inputs Any use or reliance on AI Creations Any claims made by third parties that are based on your use of our Services Any disputes between you and any other user of our Services This indemnification obligation shall survive termination of these Terms and your use of the Services. 16. Force Majeure Probull.AI shall not be liable for any failure or delay in the performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: Acts of God, natural disasters, or extreme weather events Pandemic, epidemic, or public health emergency War, invasion, hostilities, terrorism, or civil unrest Government actions, orders, or restrictions Strikes, labor disputes, or other industrial disturbances Fire, explosion, or serious accidents Cyber attacks, denial of service attacks, or other malicious actions Interruption or failure of telecommunication or digital transmission links Internet slowdowns, failures, or blackouts Shortage of supplies, infrastructure failure, or failure of third-party service providers Energy shortages or power outages Other unforeseeable circumstances beyond the reasonable control of Probull.AI Such events shall excuse Probull.AI from performance for the duration of the force majeure event and any reasonable recovery period. 17. Termination 17.1 Termination by You You may terminate your account at any time by following the instructions on our website or contacting us at support@probull.ai. 17.2 Termination by Us We may terminate or suspend your access to all or part of the Services, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. 17.3 Effect of Termination Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. 18. Governing Law and Dispute Resolution 18.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. 18.2 Mandatory Binding Arbitration ANY DISPUTE ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE FINALLY SETTLED BY BINDING ARBITRATION, RATHER THAN IN COURT. THE ARBITRATOR, AND NOT ANY FEDERAL, STATE, OR LOCAL COURT, SHALL HAVE EXCLUSIVE AUTHORITY TO RESOLVE ANY DISPUTE RELATING TO THE INTERPRETATION, APPLICABILITY, ENFORCEABILITY, OR FORMATION OF THESE TERMS, INCLUDING ANY CLAIM THAT ALL OR ANY PART OF THESE TERMS IS VOID OR VOIDABLE. 18.3 Class Action Waiver YOU AND PROBULL.AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Probull.AI agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. 18.4 Small Claims Court Exception Notwithstanding the foregoing, either party may bring an individual action in small claims court. 19. Changes to Terms We may modify these Terms at any time by posting the revised Terms on our website or providing notice to you. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of such Terms. It is your responsibility to check for updates to these Terms regularly. 20. Miscellaneous 20.1 Entire Agreement These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Probull.AI concerning the Services. 20.2 Severability If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law. Any provision held to be invalid shall be revised to the minimum extent necessary to make it valid and enforceable. 20.3 No Waiver Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. 20.4 Assignment You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction. These Terms will bind and inure to the benefit of the parties, their successors and permitted assigns. 20.5 No Third-Party Beneficiaries These Terms do not confer any third-party beneficiary rights on any person or entity who is not a party to these Terms. 20.6 Headings The section titles in these Terms are for convenience only and have no legal or contractual effect.Contact Information
